On 22nd January 2026, the revised Code of Practice on Access to Part‑Time Working was issued by the Government. Prepared by the Workplace Relations Commission (WRC), the updated Code provides practical guidance to help employers and employees agree part‑time arrangements that support flexible, inclusive and modern workplaces. 
The Code reflects the Government’s commitment to expanding flexible working options and increasing labour‑market participation, particularly among parents, carers, older employees and students. 
The Key aspects of the 2026 updated code are: 
  • Purpose - The code aims to eliminate barriers to part-time work, encouraging employers to explore part-time options for all, including senior roles.
  • Best Practice - Recommends that employers develop clear, objective criteria for assessing the suitability of positions for part-time working.
  • Implementation - Requires consultation between employers and employees to consider the impact of such arrangements on business and personal needs.
  • Core Principle - Part-time employees must not be treated less favourably than comparable full-time employees, protecting against direct/indirect discrimination.
  • Procedure - A structured framework for requesting and responding to part-time, flexible, or remote working requests is encouraged, ensuring transparency.
  • Relevant Legislation - The code is designed to be used in conjunction with the Protection of Employees (Part-Time Work) Act 2001 and the Employment Equality Acts 1998-2021
Employers are encouraged to review their policies and publish gender‑balanced data on the take‑up of flexible working to promote transparency.
