Just a reminder for all our clients as this month we have been busy answering your HR queries about contracts.

All employers are required under the Employment (Miscellaneous Provisions) Act 2018 (effective since 4th March 2019) to give their staff a statement of core terms of employment within the first five days of their employment. This gives you time to prepare a contract for the new staff. A new contract should then be issued with 8 weeks. A contract ensures there is a mutually agreed clear understanding of what is expected by both parties throughout the course of employment.

The requirement for this Core Terms of Employment is set out.

Statement of Core Terms of Employment are:
  • The full name of the employer and the employee
  • The address of the employer
  • The expected duration
  • The rate of pay or the method of calculation of pay reference period [example - hourly rate of pay and paid weekly [reference period]
  • The number of hours and days per week that the employer expects the employee to work.

Please note: If an employer fails to comply with the core statement document they may be subject to fines up and/or imprisonment.
